Gifting Terms & Conditions

These Gifting Terms and Conditions between you and Hip Bar Private Limited (“HipBar”) describe your ability to purchase and redeem Gift Cards that can be used in relation to the products you can purchase on the HipBar Platform (this includes the mobile application “HipBar” and the website www.gifting.hipbar.com)

By purchasing the Gift Card, accepting and retaining the Gift Card or using the Gift Card, you agree to the following Terms and Conditions (as may be amended by HipBar from time to time).

1. The Gift Cards will be loaded on the HipBar Gift Card Wallet in order to enable you to use in relation to the products on the HipBar Platform, which you may choose to purchase.

2. Types of Gift Cards:

• Generic / Denomination based Gift Card : A Gift Card that contains a specific amount of money. These cards can be used for any product transactions once the Gift Cards are moved to Gift Card Wallet.

• Product Gift Card : This is gifting a specific product. This Gift Card can either be used in relation to a specific product or can be loaded to the Gift Card Wallet so that it can also be used to purchase any product on the platform.

Currently, through the website www.gifting.hipbar.com , only Product Gift Cards can be gifted.

3. Limitation:

• Multiple Gift Cards can be purchased and issued in a month. However, the value of each Gift Card cannot exceed the denomination of INR 10,000/- or such other limits that may be determined by HipBar from time to time.

• Gift Cards, including any unused Gift Card balances, expire one year from the date of issuance.

• Gift Cards cannot be used to purchase other Gift Cards. Gift Cards cannot be reloaded, resold, transferred for value or redeemed for cash.

• Unused Gift Card balances associated with a HipBar Gift Card Wallet may not be transferred to another HipBar Gift Card Wallet / HipBar Wallet.

4. Redemption:

• The Gift Card can only be redeemed against products that are displayed on the HipBar platform and indicated as being available with the licensed alcohol beverage retailer.

• Multiple Gift Cards can be redeemed but the total redemption value cannot exceed ₹ 20,000/- per month. However, for Prime Account (users who have completed full KYC verification) for their HipBar account, this redemption limit shall be ₹ 1,00,000/- per month.

• All purchase of products from the HipBar platform shall be deducted from the Redeemer’s Gift Card Wallet. The unused balance, if any, shall remain in the Redeemer’s Gift Card Wallet until the date of expiry of the said Gift Card. Such unused balance cannot be transferred to another HipBar Gift Card Wallet. If the product value exceeds the Redeemer’s Gift Card Balance, the remaining amount shall be paid by other payment mechanisms available on the HipBar Platform. In this case, no additional fees or charges shall be applicable.

• If the value of the Product is lesser than the Product Gift Card, the differential value shall be converted into Generic Gift Card and the same will be added into the Gift Wallet.

• HipBar shall provide You with information on the status of redemption of the Gift Card that they have gifted.

• You can resend the Gift Card to the Redeemer’s Mobile Number/E-mail ID. This shall be applicable only to the Gift Cards that have not already been claimed or redeemed.

5. Refund:

• You can cancel the Gift Card prior to the redemption. However, cancellation charges shall be applicable in accordance with HipBar’s Cancellation policy (Point 6)

• The Gift Card can be revalidated post the expiry period on Your request.

• You may approach HipBar for a refund of the balance in the Gift Card within three years from the expiry of the Gift Cards. The refund amount shall be paid to Your bank account.

6. Cancellation:

• Generic gift cards - Can be cancelled before redemption. If the gift recipient has already redeemed the product, subsequent cancellation will not be possible.

• Product gift cards - Can be cancelled before redemption/expiry whichever happens earlier. If the gift recipient has already redeemed the product/ if the product has expired, subsequent cancellation will not be possible.

• Value of product gift cards converted - If the gift recipient has converted the value of a product gift card and added the same to his/her gift wallet, the gift card cannot be cancelled.

7. Governing Law & Jurisdiction:

• These Terms and Conditions are governed by and shall be construed in accordance with the laws of India.

• You agree that Courts in Chennai, India shall have exclusive jurisdiction in respect of disputes between you and HipBar.

8. Indemnification:

• You agree to indemnify HipBar for any and all claims brought by third parties against HipBar and its affiliates arising out of or in connection with a breach of any of these terms and conditions.

9. Limitation of Liability:

• HipBar does not make any warranties, express or implied, with respect to Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a Gift Card is non-functional, Your sole remedy will be the replacement of such Gift Card.

10. General Terms and Conditions:

• No interest shall be payable by HipBar on any Gift Card or Gift Card balance held in the Gift Card Wallet.

• There is no limitation on the number of Gift Cards that can be added to a single HipBar Account.

• If the Gift Card is redeemed without the permission of the prospective Redeemer, HipBar shall not be held responsible and retains the right to close the Gift Card Wallet. HipBar can claim alternative forms of payment if a fraudulently obtained Gift Card is redeemed.

• For any disputes regarding purchasing or redeeming a Gift Card, You may refer to HipBar’s Customer Grievance Policy which is accessible here..
